(1.0) Please read these terms and conditions carefully before ordering any services from our web site Motoroads.com, as they contain important information about your rights and obligations and you will be bound by them.
(1.1) By ordering any car rental services from our web site, you agree to be legally bound by these terms and conditions of use as they apply to your order. These terms and condition s apply to all car rental services supplied by us and our partners, suppliers, contractors and subcontractors and you and we agree that these are the only conditions that will apply.
(1.2) Our web site is a place for you to select and order a Car rental service from Motoroads Ltd and /or from our partners, suppliers, contractors and subcontractors. Our web site describes the car rental service in more details.
(1.3) Please note that the contents of our web site are aimed only at users aged 21 and above, and you must be 21 years or over to order a car rental service, using the payment method displayed on our web site. All orders must be placed at least 12 hours in advance of your car collection.
(1.4) Motoroads is entitled to refuse any order placed by you. If your order is accepted, we will confirm acceptance to you by online Reservation Voucher sent to the e-mail address you have given to us on ordering.
(1.5) You confirm that all details you provide to us for the purpose of purchasing the Car rental service will be correct, that the credit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of the Car rental service. We reserve the right to obtain validation of your credit or debit card details before providing you with the Car rental service. If validation cannot be obtained and payment is not made, we reserve the right to cancel the reservation and the service will not be performed. We will advise you as soon as possible to the e-mail address you have given us if we have to cancel the Car rental service you have booked.
(1.6) Details of our prices for the Car rental services, and the procedures for payment and delivery are displayed on our web site. The price of any Car rental service is the price displayed on our web site at the date and time of your order. We may change the price of any Car rental service on our web site at any time before you place an order. We try to ensure that the prices displayed on our web site are accurate but the price on your order will need to be validated by us as part of the acceptance procedure. We will inform you if a Car rental service's correct price is higher than that stated in your order and you may cancel the order and decide whether or not to order the Car rental service at the correct price. If you decide to cancel the order in such a case, we will refund you all the moneys you have paid.
(1.7) Prices quoted are total, per day, per vehicle for the respective price/rental period. We complementary cover the credit card handling charge for the deposit paid in advance only. We do not cover the credit card processing fee for your balance payment. Please, contact us prior to travel if you are traveling with ski equipment, golf clubs, surf boards or any other exceptional item to confirm they will fit your car rental luggage compartment. A larger vehicle size may be required.
(1.8) You must pay by credit card the amount requested in advance to secure your Car rental service and the balance upon car collection at the respective AIRPORT/HOTEL/ADDRESS.
(1.9) Car rental reservations made via Motoroads.com are final after the deposit requested in advance is received in full. If you fail to send your reservation deposit, we may cancel your booking at any time. The deposit paid in advance is non-refundable. In case of cancellation it can be consumed in full on your next booking with Motoroads. In addition, refunds that shall be made to you shall be your full payment made less: any applicable deductions, fees or charges applied by Motoroads and/or the services provider and/or partnering banks. Modification of an existing reservation is subject to availability and surcharges.
(2.0) The voucher we send you via email constitutes your car rental booking. It contains vital information regarding your car rental reservation and our office contact information. You must carry with you and show your car rental voucher upon car collection. Motoroads and/or its subcontractors can not be held liable for rental failures and overcharges due to the voucher was not carried/presented by the customer.
(2.1) The renter must provide a valid driver license and a travel passport upon car collection. The name on the credit car the booking was made/secured with has to match the name that will appear on the rental contract. If different both names are to be included on the rental contract.
(2.2) All car rentals provided by Motoroads include: Unlimited mileage, Third party liability coverage, CDW (Collision damage waiver), VTW (Vehicle Theft Waiver), Prepaid road taxes, Up to 2 child/booster seats for free, Up to 3 drivers free of charge, Free road map, 24-hours breakdown assistance, 24-hour telephone line support.
(2.3) The insurance included in your car rental do not cover events like - loss of car keys and documents, car returned with fuel tank not full, severe damage to car tires and wheels, loss of personal belongings, etc. If the car rental vehicle is claimed stolen and keys are not presented to the rental supplier, the insurance is deemed void.
(2.4) Insurance Liability/Deductible in case of an accident or theft of the vehicle vary as follows: 0-150 EUR for Economy class vehicles, 150-250 Euro for Compact and middle sized cars and from 250 to 500 EUR for minivans, vans, SUVs and luxury models. In most of the cases when the police report states it was not your fault for an accident, you do not pay an excess amount.
(2.5) All rental vehicles are provided with a full fuel tank and should be returned full, otherwise EUR 1,5/liter refueling charge will apply.
(2.6) Your balance payment due upon car collection is payable in the following currencies: EUR, GBP, BGN (Leva), USD. Bulgarian central bank exchange rates apply as per the collection/payment day.
(2.7) Providing Motoroads with you accurate flight information well in advance is essential. Motoroads and its subcontractors can not accept responsibility for a failed rental due to the late/non-provision of this information.
(2.8) Although we advertise a particular models for rent, we can not guarantee that specific make, model or fuel type of car. We will do our best to provide you with exactly the same vehicle as per your voucher, but we may substitute it to an alternative, similar or upgraded car at no extra cost. If, at the time of pickup, we are not able to provide you with the car as shown on your rental voucher due to breakdown or an accident, a similar or upgraded car will be supplied.
(2.9) The customer is fully responsible for the cost of any parking fines and traffic police penalties incurred during the rental contract. Motoroads and its subcontractors in charge of your car rental service will pass the relevant charges on to you plus any administrative expenses.
(3.0) Motoroads and/or the company in charge of your Car rental service will make all reasonable efforts to ensure that you will be met at the collection point at the time set out in your reservation voucher. However, if you can not find our representative at the meeting point, please call us or the company in charge of your Car rental service on the numbers provided in your reservation voucher. Motoroads will not be liable for any loss or costs you suffer or incur through any reasonable or unavoidable delays. Motoroads and the company in charge of your Car rental service will not be responsible for any losses you suffer (including for example any missed flight/bus/train) due to your failure to allow sufficient time for your car return and the procedures involved. Motoroads can not be held liable for any losses you suffer (including for example any missed flight/bus/train) if the car rental company in charge of your booking fails to provide the Car rental service for a reason of its own competence and responsibility.
(3.1) If your outbound flight is delayed, your Car rental service will automatically be amended and our representative will meet you at your revised time of arrival. Please note additional after business hours supplements may be applicable.
(3.2) If your outbound flight is diverted for any reason, we will use reasonable endeavors to rearrange a car rental service from your new arrival point at the revised landing time. In situation where notification of the diversion of you r flight is too late, you may have to book another car rental service and pay additional charges.
(3.3) If your flight is diverted, we recommend that you contact us as soon as possible. Please note that, subject to their terms and conditions, it is the responsibility of the airline to transport you to your original destination airport.
(3.4) ALL CAR RETURNS FOR A SERVICE FROM YOUR HOTEL/ADDRESS TO THE RELEVANT AIRPORT MUST BE CONFIRMED WITH THE MOTOROADS OR THE COMPANY IN CHARGE FOR YOUR CAR RENTAL SERVICE AT LEAST 24 HOURS BEFORE YOUR FLIGHTS DEPARTURE. IT IS YOUR RESPONSIBILITY TO CONFIRM YOUR CAR RETURN TIME/LOCATION AND IF YOUR BOOKING IS NOT SO CONFIRMED, MOTOROADS AND THE COMPANY IN CHARGE OF YOUR CAR RENTAL SERVICE WILL NOT BE LIABLE FOR ANY LOSSES OR ADDITIONAL COSTS YOU INCUR BECAUSE OF A LATE CAR RETURN.
(3.5) It is the customers responsibility to travel with their Confirmation Reservation Voucher which lists arrival instructions and all of the relevant local contact numbers in the event of an emergency and local office reconfirmation hours and contact number. This is made clear at the end of the booking process. Motoroads and the company in charge of your Car rental service accept no responsibility or compensation claims for any loss of service should the customer not travel with their booking confirmation voucher.
(3.6) If you encounter a problem with the service provided, please inform Motoroads and the company in charge of your Car rental service immediately using the numbers given to you in your reservation voucher, and we will immediately endeavor to put things right. Failure to notify us of your complaint at this stage will affect our ability to investigate the matter complained of, and your rights under the contract. Please, note that any complaints must be received in writing by Motoroads and the company in charge of your car rental service.
(3.7) If you have any service issues upon your return, you should direct them to us via email at: or by fax: + 359 24 808 553 immediately.
(3.8) Returning the car earlier than the confirmed time in your rental contract is allowed, but rental rate recalculation based on the shorter hire period and a penalization fee (1-3 renal days) apply.
(3.9) Rental period extension can be arranged, but they are subject to availability and at least 24-hour notification in advance to our rental office. All extensions have to be confirmed by Motoroads rental office in writing/via email.
(4.0) If your booking details change, you can amend your booking up to 24 hours prior to your car collection, subject to payment of any difference in the applicable prices. We reserve he right to charge a 25 EURO administrative fee or more for amendments made less than 24 hour prior to car collection. Such last moment changes are subject to full rental rate payment (as per your voucher) plus any additional applicable fees. We do not make any refunds for car rental amendments or cancellations made less than 24 hours prior to car collection.
(4.1) 24-hour breakdown assistance is included in our rental rates. Depending on the circumstances, Motoroads and its subcontractors reserve the right not to provide a replacement vehicle.
(4.2) All rental vehicles must be returned in the same condition as collected/delivered. Excessive staining or internal damage to the interior of the vehicle is subject to additional charges.
(4.3) Please note in Bulgaria it is forbidden to transport children and infants without the correct safety seat, according to their height and weight. We supply up to 2 child seats for free. However, we strongly recommend that you bring your own correctly fitted car seat for your child to insure your safe trip.
(4.4) Please inform us at the time of booking if you wish to travel with access baggage including, but not limited to, surfboards, bicycles, pet carriers or other over-sized items. This is to ensure that our vehicles can accommodate you. Should you fail to notify us at the time of booking, you may be liable for any additional costs incurred in the carriage of such items.
(4.5) We reserve the right within our reasonable discretion to terminate the car rental service, if you or your party's conduct or behavior is disruptive in any way and/or affects your safety or that of other parties. We shall not accept liability for any extra costs incurred by you/or your party as a result of our doing so.
(4.6) Passengers and drivers are not permitted to take alcoholic drinks onto the vehicles for the purpose of consuming them while operating the vehicle. We further reserve the right not to provide a car rental service to any person who is thought to be under the influence of alcohol or drugs.
(4.7) We will not be liable for any injury, illness or death or consequent losses suffered by you or any member of your party where such injury, illness or death was not caused by lack of reasonable care/skill on our part or that of our suppliers in performing our obligations under the contract.
(4.8) We will not be responsible for any claim arising as a result of any or all of the following:
a) the fault of the person(s) affected or any member(s) of their party or
b) the fault of a third party not connected with the provision of the service which we could not have predicted or prevented or
c) the fault of anyone who is not carrying out work for us (generally or in particular) at the time or
d) an event or circumstance that we or the supplier(s) of the service in question could not have predicted or prevented. This may include (but is not limited to) an occurrence of force majeure as described in these booking conditions.
(4.9) The Car rental services are provided to you for private use only and this is a consumer contract. Accordingly, we accept no liability for any business loss (which includes without limitation any loss of contracts, loss of prof its, loss of revenue or loss of anticipated savings in expenditure or any loss or corruption of data) however caused, even if foreseeable.
(5.0) We promise that all Car rental services you purchase from our web site will be performed with reasonable skill and care and, as far as reasonably possible, in accordance with our agreement. We will do our best to ensure that all materials and information published on our web site are accurate, but regrettably errors do occur, and we reserve the right to rectify such errors before your booking is confirmed.
(5.1) Force majeure means that we will not pay you compensation if we have to cancel or change the service because of unforeseeable circumstances beyond our control. These include for example, war, threat of war, terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority, industrial dispute, natural or nuclear disaster, fire, adverse weather conditions.
(5.2) We may transfer or subcontract any or all of our rights and obligations under these terms and conditions at any time.
(5.3) We may alter these terms and conditions from time to time and post the new version on our web site, following which all use of our web site will be governed by that version. You must check the terms and conditions on the web site regularly. The terms governing the purchase of any Car rental service will be the terms in place at the time of your order.
(5.4) These terms and conditions together with your reservation voucher and the car rental contract, are the whole agreement between you and Motoroads.
(5.5) A person who is not a party to our agreement has no rights under the Contracts. (5.6) If any provision or term of these terms and conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be deleted but all other terms will remain valid. (5.7) Notice will be deemed received when an email is received in full (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt) or 48 hours after the date of posting.
(5.8) You are not allowed to take the rental vehicle outside Bulgaria under any circumstances without the explicit permission and authorization letter from Motoroads or the contract ed car rental company. If your rental package includes cross-border option, you need to obtain a green card from Motoroads or the car rental company in charge of your booking.
